Tennessee Architects’ and Engineers’ Board

Enforcement of QBS

In July, you received a notice from the Board about the new provision in the Rules of Professional Conduct giving the AE Board the authority to enforce the provisions of the Qualifications-Based Selection law relating to providing a price when requested by local government for public works projects.  This rule went into effect in March 2013.  Click here to review that memo from the Board.

At the AE Board meeting in August, TSPE learned that an architect filed a complaint against another architect for submitting a price in response to a request from local government.  The complaint was approved for a formal hearing, which means it is a serious matter.  I encourage you to review the Rules of Professional Conduct, specifically 0120-02-.02 (6) on the second page. TSPE members may email Kasey Anderson for a “generic” letter to use to notify local governments of this prohibition.

John Cothron, Executive Director of the AE Board, and Board Member Hal Balthrop discussed this issue at length during a session at the Annual Meeting in September.  If you have questions about “gray” areas, submit them to John Cothron.
